Article 1: General provisions

Steviala is an online store, providing information about sugar free products and selling products without added sugars.

The terms and conditions apply to the B2C and B2B customer using the Steviala online shop or placing orders by mail. Terms and conditions of the customer are only effective as far as Steviala accepts them in written form.

By placing an order, the customer accepts the terms and conditions applicable at Steviala at that time.

The webshop of Steviala with registered office in Kapellen (Belgium), Antwerpsesteenweg 93/7, VAT NL824303325B01 (hereafter Steviala) offers its customers the possibility to purchase its products online or, in exceptional cases, to place orders by mail. These General Terms and Conditions ("Terms and Conditions") apply to all items in the Steviala assortment and any purchase made by the customer with Steviala.

The customer accepts that these Terms and Conditions of STEVIALA will be the only ones applicable and that any Terms and Conditions of the customer are ALWAYS inferior to those of STEVIALA.

The customer shall prevent any form of illegal/unauthorised using of the goods and/or services or causing the services and/or goods offered to be used for unlawful acts, the commission of offenses and/or for acts contrary to these Terms of Use or the General Terms and Conditions. The customer may not apply any processes or actions, which he can reasonably suspect will obstruct Steviala and/or Steviala's customers or adversely affect the use of services and/or goods.

The customer is responsible and liable for any use of the services provided and goods purchased, including the confidentiality and use of his access codes, e-mail addresses, etc.... The customer is not entitled to transfer any rights and obligations arising from this or any other agreement to third parties without Steviala's prior written consent.

Article 2: Price

All prices on the website include VAT for individuals. Payment is made with euro as currency. When new prices are set, all previous prices lose their validity.

Shipping costs are not included in the communicated prices of the products.

We reserve the right to cancel and refund your order due to incorrect price indications.

The indication of price refers exclusively to the articles as it is described.

The accompanying photo is for decorative purposes and may contain elements or items not included in the price.

Article 3: Offer

Each offer is only open to customers resident in the European Union. The articles with B2C final destination are intended exclusively for normal private use.

Steviala is only bound by an obligation of means concerning the accuracy, updating or completeness of the information offered.

Steviala is in no case liable in case of material errors, typesetting or printing errors.

The offer is always valid while supplies last and may be modified or withdrawn by Steviala at any time.

Steviala is entitled -without giving any reason- to refuse orders, to adjust delivery times, to split deliveries, or to attach other conditions to the delivery.

Article 4: Online purchases

The purchase is made when the customer receives a confirmation e-mail from Steviala. After placing an order, the customer will receive an e-mail confirming his order. The conclusion of the contract of sale will not take effect until the private customer has paid. If there are any literal errors, wrong prices, spelling mistakes or others on the webpage, Steviala is allowed to correct them even after the order has been placed. Private customers pay online immediately. Resellers can pay online or by invoice. For the last choice, the invoice amount must be in Steviala's account at the latest one month after the invoice date.

If a product is not available contrary to expectations, Steviala is not responsible for these reasons. If the goods ordered are not available, the customer will be informed.

In case of a withdrawal, any payment already made will be immediately (+/1 week) returned by Steviala. The customer has the option to purchase the items from the Steviala assortment online.

Article 5: Complaints

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery, must be reported immediately, under penalty of forfeiture of any right.

Article 6: Cancellation period

The provisions of this article apply only to customers who purchase items online in their capacity as consumers:

The consumer has the right to notify Steviala that he renounces the purchase, without payment of any penalty and without giving any reason within 14 days from the day following the delivery of the product.

Customers wishing to exercise the renunciation right must contact Steviala within 14 days from delivery and/or request a return on the website. The returned goods must be returned to Steviala within 14 days of receipt at the customer's expense.

Only items that are in their original and undamaged packaging.

Will under no circumstances be taken back:

  •  used, soiled, damaged or incomplete articles
  • articles of which the packaging (or a part thereof) has been opened
  • articles that have been custom-made for the customer
  • articles that cannot be returned due to their nature
  • articles ordered especially for the customer.

Article 7: Delivery

The delivery of the order will be made as quickly as possible by DHL, DPD or POST.NL. For B2B orders it can also be a pallet delivery by an external party. The delivery time depends on the destination (usually 1 to 2 working days in Belgium and the Netherlands). All specifications of delivery times and delivery dates are non-binding due to possible problems of the courier and/or transport service. Steviala is not liable for delivery delays caused by the courier service or by a product out of stock.

If a delivery is delayed because a product is temporarily out of stock, the customer will be informed as soon as possible. In this case, the customer can cancel his order and if he has already made a payment, he will be refunded immediately.

There is no minimum order value.

The return of opened goods is not possible.

Article 8: Shipping costs

The shipping costs for deliveries within Belgium and the Netherlands are 7,95€ up to 59,99€ for individuals. From 60,00€ shipping costs are free for B2C customers. For B2B orders, prices vary depending on destination, amount of the order and weight.

Article 9: Payment and property rights

The private customer pays in advance using 1 of the specified payment methods. The B2B customer has the choice of paying online or paying by invoice with a due date of 30 days.

If the customer wishes to pay by bank transfer, Steviala will notify him of the bank details at the end of the ordering process and this via email. The delivery of the goods will not take place until the full invoice amount is received in the specified account. If payment is not received within fourteen days, the order will be considered cancelled. Until the full invoice amount, both for B2B and private customers, has been received, the goods will remain the property of Steviala. If only part of the invoiced amount is paid, Steviala reserves the right to cancel the order and/or reclaim the unpaid goods and/or refund the (partially) paid amount of the delivery, even the clienst filed for bankruptcy. Moreover, Steviala reserves the right to charge fees for such a refund.

Article 10: Privacy

We treat your data as confidential information and will never transfer, rent or sell it to third parties. You may at any time request, correct, change or delete your data that we keep in Steviala's customer list, and you may refuse to allow Steviala to use your data to send you information. Steviala strictly respects the Belgian law of December 8, 1992 on the protection of privacy in the processing of personal data.

The Steviala website uses cookies. Cookies consist of a standard Internet technology that allows certain information to be stored and accessed on the user's system. Cookies cannot be used to identify individuals, a cookie can only identify a machine. Any Internet user can set their computer to not accept cookies. If your computer does not accept cookies, it is possible that you will experience problems during the ordering process. Should this be the case, please contact us so that we can still enter your order.

Steviala reserves all intellectual property and other rights to this website and the products and services provided through this website. You are permitted to download and print the information provided for your own personal and non-commercial use. It is not permitted to copy, reproduce or in any way distribute or publish the content of this website without prior written permission from Steviala.

Article 11: Impairment of validity - non-derogation

If any provision of these Terms is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by Steviala to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 12: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to and Steviala's general conditions of sale. In case of contradiction, these Terms and Conditions shall prevail.

Steviala may modify these Terms at any time without further notice. Any purchase made after the modification implies acceptance by the customer of these new Terms.

Article 13: Proof

The customer accepts that electronic communications and backups may serve as evidence.

Article 14: Applicable law - Competent court

All contracts concluded with Steviala are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
